Welcome to Piqly. These Terms of Service (“Terms”) govern your access to and use of the Piqly mobile application (the “App”), operated by Piqly, LLC (“we,” “our,” or “us”).

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 16 years old to use Piqly.

By using the App, you represent and warrant that:

• You are at least 16 years old

• You have the legal capacity to enter into these Terms

• You will comply with all applicable laws and regulations while using the App

2. Account Registration

To use certain features, you may be required to create an account.

You agree to:

• Provide accurate and truthful information

• Keep your login credentials secure

• Be responsible for all activity under your account

You are responsible for maintaining the confidentiality of your account credentials.

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms or misuse the App.

3. Use of the App

Piqly allows users to upload photo sets of themselves and receive anonymous votes from other users on which photo is preferred.

The App is designed to help users compare different photos of the same person, not to compare or rank different individuals against each other.

You agree not to:

• Upload content that is illegal, explicit, hateful, abusive, harassing, or otherwise inappropriate

• Upload photos of anyone under 16 years of age

• Upload photos of another person without their permission

• Upload content that infringes intellectual property rights

• Upload misleading or impersonating content

• Attempt to manipulate voting or interfere with the operation of the App

We reserve the right to remove content or restrict access to the App if we determine that content violates these Terms or our community guidelines.

4. User Content

You retain ownership of any photos or content you upload to the App.

By uploading content, you grant Piqly a non-exclusive, royalty-free, worldwide license to host, display, store, process, and analyze the content solely for the purpose of operating, maintaining, and improving the App.

This license ends when your content is deleted from the App.

You represent and warrant that:

• You own the content you upload or have the necessary rights to use it

• The content does not violate any laws or third-party rights

• You have permission from any identifiable person appearing in the content

5. Voting and Insights

Votes within the App are anonymous and aggregated.

The App may generate insights based on aggregated voting behavior, including demographic trends such as age group, gender, or region.

We do not guarantee:

• A minimum number of votes

• Specific outcomes or results

• That insights represent universal opinions

All insights are provided for informational purposes only and should not be interpreted as objective or professional evaluations.

6. Subscriptions and Payments

Piqly offers optional paid subscriptions (“Premium”) that unlock additional features.

Subscriptions:

• Are billed through your Apple ID account

• Renew automatically unless canceled at least 24 hours before the end of the current billing period

• May be managed or canceled through your App Store account settings

Payment will be charged to your Apple ID account at confirmation of purchase.

Except where required by law, subscription payments are non-refundable.

7. Termination

You may stop using the App at any time.

We may suspend, restrict, or terminate your access if you violate these Terms, misuse the App, or create risk for other users or the platform.

Upon termination, your right to use the App ends immediately.

8. Disclaimer of Warranties

The App is provided “as is” and “as available.”

We make no warranties regarding:

• The accuracy of voting results or insights

• Continuous availability of the App

• Fitness for a particular purpose

Your use of the App is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Piqly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Our total liability for any claim relating to the App shall not exceed the amount you paid to use the App, if any.

10. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will post the updated Terms within the App or on our website. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the United States and the State in which Piqly, LLC is registered, without regard to conflict of law principles.
